PUBLIC MEETING OF THE PALM BEACH COUNTY CANVASSING OF ABSENTEE BALLOTS FOR THE SEPTEMBER 5, 2006 PRIMARY ELECTION.

In accordance with the Sunshine Law of Florida, all Canvassing Board meetings are open to the public.

The sealed absentee ballots received prior to 9:00 a.m. Friday, September 1, 2006, for the Primary Election will be available for public inspection from 9:00 a.m. until 10:00 a.m. on Friday, September 1st, at the Supervisor of Elections Absentee Ballot Facility, 4215 Cherry Road, West Palm Beach, Florida. Immediately afterwards, The Palm Beach County Canvassing Board will convene and remain in session until the results of the election are obtained. Those absentee ballots will be opened and processed beginning 10:00 a.m. until 5:00 p.m. or thereafter as needed and resume on Saturday, September 2nd, 10:00 a.m. until 5:00 p.m. or thereafter as needed. The processing, not tabulation, of the opened Absentee Ballots will continue on Sunday, September 3rd, at 9:00 a.m. until 5:00p.m. or thereafter as needed. The canvassing of those ballots will commence as soon as the Board can take them up after opening and processing. The opening and processing of the absentee ballots will take place at 4215 Cherry Road, West Palm Beach, FL.; the canvassing will take place at the office of the Supervisor of Elections, 240 South Military Trail, West Palm Beach, FL. Tabulation of all absentee ballots will not begin until after 7:00 p.m. on Tuesday, September 5th, 2006.

Pursuant to Section 101.68(2)(c)2, Florida Statutes, if any elector or candidate present believes that an absentee ballot is illegal due to a defect apparent on the voter’s certificate, he or she may, at any time before the ballot is removed from the envelope, file with the canvassing board a protest against the canvass of that ballot, specifying the precinct, the ballot, and the reason he or she believes the ballot to be illegal. A challenge based upon a defect in the voter’s certificate may not be accepted after the ballot has been removed from the mailing envelope.

Any absentee ballots received between 9:00 a.m. Friday, September 1, 2006 and 7:00 a.m. on Election Day, September 5th, 2006, as well as between 7:00 a.m. on Election Day, September 5, 2006 and 7:00 p.m. on Election Day, September 5, 2006, will be available for public inspection until opened. Those wishing to inspect absentee ballots received during that time period must be present throughout September 5, 2006. At 10:00 a.m. on September 5, 2006 the Canvassing Board will reconvene for canvassing of the absentee ballots and other Board business at the office of the Supervisor of Elections, 240 South Military Trail, West Palm Beach, FL. Shortly after receipt, those ballots will be opened and processed; however, not tabulated until after 7:00 p.m. on Election Day, September 5, 2006. 

The Palm Beach Canvassing Board will continue it's canvassing of absentee ballots, remaining in session until the results of the election are obtained.

The Palm Beach County Canvassing Board will reconvene at noon on Wednesday, September 6th, 2006, at the office of the Supervisor of Elections, 240 South Military Trail, West Palm Beach, to canvass precinct returns and provisional ballots and other Board business.

Thereafter the Palm Beach County Canvassing Board will remain in session from day to day to complete its canvassing duities and other Board business until the results of the Election are obtained. The Board will reconvene at 10:00 a.m., Tuesday, September 12th, 2006, to continue canvassing the provisional ballots and other Board business.

The time and date of any changes to any of the above will be posted at the Supervisor of Elections office as well as online at www.pbcelections.org and announced during the preceding Canvassing Board Meetings.

NOTE: Section 286.0105, Florida Statues, states that if a person decides to appeal any decision by a board, agency, or commission with respect to any matter considered at a meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
